Respondents Petition filed under Article 226 of the Constitution of India praying for the issue of a writ of mandamus, directing the 1st and 3rd respondents to instruct the 5th respondent based on the petitioner representation dated 23.03.2015 to stop the proposed construction in the pond comprising in S.No.32, measuring about 39.50 cents situated at Nagal Village, Katpadi Taluk, Vellore District and ensure the pond to storage the water to maintain the ground water level for the benefit of villagers.

(The Order of the Court was made by The Hon'ble The Chief Justice) There is no material on record to show that the area of construction is only a pond and the learned counsel for the petitioner seeks to withdraw the writ petition, with liberty to file a fresh petition, after collecting relevant materials.

2. Liberty is granted to the petitioner to file a fresh petition, after collecting relevant materials and making representation to the respondents thereafter, giving reasonable time to the respondents to respond to the representation.

3. The writ petition stands closed. No costs. Consequently, M.P.No.1 of 2015 is closed.
