The present Miscellaneous petition has been filed seeking to condone the delay of 647 days in filing the revision petition against the order passed in Crl.A.No.45 of 2018 by the Sessions Judge Magalir Neethimandram (Fast Track Mahila Court, Udhagamandalam, Nilgiris).

2. The learned counsel for the petitioner submits that though the lower Court in S.T.C.No.988 of 2014 convicted the petitioner and directed him to pay compensation to a sum of Rs.3,80,000/- which was confirmed by the Fast Track Mahila Court, Udhagamandalam, Nilgiris in Crl.A.No.45 of 2018 vide Judgement dated 05.04.2021, however the petitioner is ready to pay the entire compensation as awarded in S.T.C.No.988 of 2014 within the time frame that may be stipulated by this Court. Hence, he prayed this Court to condone the delay in filing the above revision.

In view of the submission made by the learned counsel for the petitioner and considering the inordinate delay, this miscellaneous petition is allowed and the delay of 647 days in representing the above revision, is condoned subject to condition that the petitioner is directed to deposit a sum of Rs.3,80,000/- to the credit of S.T.C.No.988 of 2014 within a period of two (2) weeks from the date of receipt of a copy of this order. On filing of proof of said deposit is made, the Registry is directed to number the criminal revision, if the papers are otherwise in order. Failing compliance of the above order, the petition shall stand dismissed automatically, without further reference to this Court.

5. Post the main case on 30.04.2024.
