Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Mandamus directing the 4th respondent to dispose of petitioner application dated 31.08.2009 under the regularization of the purchase of land under innocent buyers category on payment of necessary fees as directed by the Government within a time frame stipulated by this court and to pass orders.

ORDER

This writ petition has been filed seeking for a direction to the 4th respondent to consider the petitioner's application dated 31.08.2009 wherein the petitioner has sought regularisation of the purchase of land under the Innocent Buyers Scheme, more fully disclosed in the affidavit filed in support of the writ petition, within the time frame to be fixed by this Court. 2.

The petitioner claims that she was not aware of the urban land ceiling proceedings at the time of purchasing the land and therefore, she falls under the innocent buyer scheme introduced by the Government. Hence, she seeks regularisation under the said scheme. In this regard, the petitioner had submitted an application on 31.08.2009 to the 4th respondent. However, according to her, no enquiry has been conducted on the said application, and despite repeated follow-ups, no final orders have been passed, till date.

No prejudice would be caused to the respondents if the petitioner's representation, as stated supra, is directed to be considered on merits and in accordance with law by the respondents, after giving due consideration to the supporting documents filed by the petitioner, within a time frame to be fixed by this Court.

This Court is not expressing any opinion on the merits of the petitioner's representation.

In view of the above, this writ petition is disposed of with a direction to the 4th respondent to consider and dispose of the petitioner's representation dated 31.08.2009 on merits and in accordance with law, seeking regularisation of the property more fully described in the affidavit filed in support of this writ petition under the innocent buyers scheme, after giving due consideration to the supporting documents filed by the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.
