Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 1st respondent to take necessary action in relation to cause of death of the petitioner's son, by considering the petitioner's representation dated 03.12.2018 and consequently directing the 2nd respondent to expedite the enquiry and to file final report to early or the time may be stipulated by this Hon'ble Court. Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondents. By consent of the parties, this main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a mandamus directing the first respondent to take necessary action in relation to cause of death of her son, by considering her representation dated 03.12.2018 and consequently, directing the 2nd respondent to expedite the enquiry and to file a final report.
3. It is stated by the petitioner that her son by name Mahendran committed suicide on 29.07.2018 and in pursuant to filing of the police complaint, though the Post-Mortem was conducted, however, the final report has not been filed by the respondent-Police so far. Therefore, it is claimed by the petitioner that such report has to be filed immediately. Ventilating such grievance, the petitioner has sent the above representation.
4. The learned Special Government Pleader appearing for the respondent, based on instructions, submitted that the report from the Chemical Analysis Lab is awaited and once such report is received, final report will be filed by the respondentPolice. Therefore, he seeks for four weeks time to file such report.
5. By recording the above said submissions made by the learned Special Government Pleader for the respondents, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
