The petitioner is the first defendant in the suit. She is the wife of deceased and entitle to get all the terminal benefits. But the first respondent/plaintiff claiming himself as adopted son has preferred the suit preventing the petitioner/first defendant and her children from getting all terminal benefits, who is legally entitled on account of the death of her husband.
2. The learned counsel for the petitioner would further submit that the suit has been filed by the first respondent/plaintiff with an intention to drag on the proceedings. Therefore, she would seek a direction for early disposal of the suit.
3. Without going into the merits of the case, a direction is issued to the District Munsif, Gudiyattam, to dispose of the suit in O.S.No. 9 of 2015, within a period of three months, from the date of receipt of a copy of this order.
