ORDER

The petitioner filed the present Writ Petition seeking issuance of Writ of Certiorified Mandamus to quash the order of appointment of the third respondent and consequently direct the first respondent to appoint the petitioner as Anganwadi helper. 2.

The petitioner's case is that she has passed 5th standard and she is a widow and has one daughter to take care of. She applied for the post of Anganwadi Helper. However, in total violation of G.O.Ms. No.110 dated 14.05.2012, the third respondent was appointed though she resides in different hamlet viz., Gownur, which is three kilometre away from the Anganwadi centre.

However, in the additional counter filed by the second respondent, it is seen that the third respondent resides in Gownur village

which also forms part of the same village Panchayat. Even in respect of marks secured, the petitioner has been awarded full five marks as she resides within one kilometer from the centre. Whereas the third respondent has been awarded 3 marks which implies that she resides within two kilometers from the centre. Moreover, in the over all marks obtained in the interview, the third respondent has scored above the petitioner by a clear 10 marks.

Therefore, this Court finds no infirmity or irregularly in the order of the first respondent appointing the third respondent. Consequently the present petition deserves to be dismissed. Accordingly, the Writ Petition stands dismissed. Consequently, connected miscellaneous petition is closed.
