..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 01.03.2018, 27.03.2018, 04.07.2018, 26.12.2018 and 10.01.2019 and to treat the period of suspension from 20.03.2009 to 03.12.2010 as duty for all purposes, pre-pone her date of declaration and completion of his successful probation period in the post of Assistant Engineer/ Electrical by excluding the period of suspension and to promote her as Assistant Executive Engineer (Electrical) with effect from 27.02.2018 on par with her juniors with due and appropriate benefits and with all monetary benefits.

O R D E R

The grievances of the writ petitioner is that her promotion to the higher post was deferred on account of the pendency of the criminal case.

2.The learned counsel for the writ petitioner states that the criminal case ended with an order of acquittal and therefore, the case of the writ petitioner is to be considered with reference to the rules in force for promotion to the higher post on par with her junior.

3.In this regard, the writ petitioner submitted a representation to the 2nd respondent on various dates and finally on 10.01.2019.

4.Thus, without going into the merits of the matter, the 2nd respondent is directed to consider the representation submitted by the writ petitioner on 10.01.2019 and pass orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. The writ petitioner is also directed to enclose the copy of the representation and all other relevant documents, if any, along with the orders passed in the present writ petition.

5.With these directions, the writ petition stands disposed of.
