ORDER

This petition has been filed seeking to set aside the judgment and decree passed in O.S.No.3467 of 2022 31.10.2023 by the learned XV Additional City Civil Court, Chennai.

2. When the matter was taken up, it is stated by the learned counsel that the respondent/defendant has agreed to settle the dispute amicably on payment of balance advance amount and compensation to the tune of Rs.9 lakhs to the petitioner/plaintiff. It is further stated that above payment will be paid in two instalments, viz., Rs.4,50,000/- on or before 15.02.2025 and the other Rs.4,50,000/- on or before 31.03.2025. It is also agreed between the parties that on payment of the entire amount by the respondent, the plaintiff has agreed to withdraw the criminal case against the respondent, D.Moses and her daughter in law in C.C.No.2505 of 2023 on the file of CCB-I, Metropolitan Magistrate Court, Egmore. Joint affidavit of undertaking entered into between the parties dated 24.01.2025 is produced before this Court and the same is taken on record.

3. The said memo of compromise shall form part of the order. Accordingly, this Civil Revision Petition stands disposed of in terms of the memo of compromise. It is made clear that as undertaken before this Court, if the amount is not paid by the respondent, the respondent will be proceeded for contempt of Court. No costs.
