2.However, learned counsel for respondents 2 and 3 has no objection in allowing this petition.

3.Having regard to the merits of the case and the averments made in the affidavit filed in support of the above miscellaneous petition, this Court is inclined to allow this petition.

4.Accordingly, this Miscellaneous Petition stands allowed subject to any defence that may be taken by the 1st respondent at the time of hearing the appeal as regards merits of amendment.

5.Post the appeal suit for hearing on 24.04.2023.
