ORDER
This writ petition has been filed challenging the impugned refusal check slip dated 03.12.2025 issued by the second respondent refusing to register the sale deed dated 19.11.2025 presented by the petitioners for registration on the ground that the patta produced by the petitioners is a joint patta which includes the name of the respondents 3 and 4 as well, who have not given their consent for registration of the sale deed.
2. Mr.Jayachandran, learned Government Advocate, accepts notice on behalf of the respondents 1 and 2. Since no adverse orders are passed against the respondents 3 and 4, notice to them in this writ petition is dispensed with.
3. No prejudice will be caused to the second respondent if the said authority, before registering the sale deed dated 19.11.2025 presented by the petitioner for registration, issues notice to the respondents 3 and 4, whose names are also included in the joint patta, and after hearing their objections, if any, takes a final decision on whether to register the sale deed or not. In view of the same, the impugned refusal check slip will have to be quashed by this Court and the matter will have to be remanded back to the second respondent for fresh consideration, on merits and in accordance with law, after hearing the objections if any from the respondents 3 and 4.
4. Accordingly, this writ petition is disposed of in the following manner:- (a) The impugned refusal check slip dated 03.12.2025 issued by the second respondent is quashed; and the matter is remanded back to the very same respondent for fresh consideration, on merits and in accordance with law.
(b) The second respondent shall issue notice to the respondents 3 and 4 with regard to the sale deed dated 19.11.2025 presented by the petitioner for registration, and permit them to raise objections if any with regard to registration; and after hearing their objections, the second respondent shall take a final decision as to whether the sale deed dated 19.11.2025 presented by the petitioner for registration can be registered or not. (c) The second respondent is directed to complete the aforesaid exercise within a period of six weeks from the date of receipt of a copy of this order.
W.M.P.No.7707 of 2026 is ordered subject to payment of separate court fee. No Costs.
