Dhanam .. Respondent This case came up for settlement before the Lok Adalat. Both the parties are present. M/s W.Camles Gandhi, learned counsel for the petitioner and M/s T.S.Arthanareeswaran, counsel for the respondent are present. TERMS OF SETTLEMENT
Both the petitioner and the respondent along with their counsel are present. Both parties filed the Compromise Memo duly signed by them along with their learned counsel. The respondent has agreed to settle the issue by receiving total amount of Rs.4,50,000/- and out of this settled amount a sum of Rs.2,78,000/- was received by the respondent on 21.09.2022 and the balance amount of Rs.1,72,000/- shall be withdrawn from the Court deposit lying before the Judicial Magistrate No.I, Nammakkal in C.C.No.80 of 2017 and for the same the petitioner has no objection. The respondent herein is at liberty to withdraw the amount from the Court deposit on the file of C.C.No.80 of 2017 before the Judicial Magistrate No.I, Nammakkal.
2. The conviction rendered in C.C.No.80 of 2017 by the Judicial Magistrate No.I, Nammakkal dated 06.02.2020 and confirmed in the Criminal Appeal No.22 of 2020 by Judgement dated 15.12.2020 by the Principal District Judge, Nammakkal are set-aside and the sentence as well as the compensation amount awarded by the Judicial Magistrate No.I, Nammakkal and confirmed by the Principal District Judge, Namakkal, are also set-aside and the Criminal Revision herein pending is disposed of accordingly. The Joint Memo filed is the part and parcel of the records. Consequently connected Miscellaneous Petition is closed.
3. The full Court fee shall be refunded to the petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
