ORDER
This Writ Petition has been filed praying to quash the Memorandum No.2078/ PSD-F/ 2025 dated 05.02.2026 issued by the
respondent herein and consequentially to direct the respondent to process and proceed with the selection of the petitioner without insisting for the court order. 2.
The learned counsel appearing for the petitiner would submit that the petitioner completed Senior Grade Typewriting (English) in the year 2017 and he also completed B.Sc.Physics in the year 2021. While so, a complaint was lodged against the petitioner and other persons with regard to a wordy quarrel between two neighbours namely Tirunavukkarasu family and Sankar family. The petitioner entered into compromise in between the two families. However, he was added as 3rd accused in the criminal case in crime No.130 of 2024 dated 12.03.2024 for the offences punishable under Sections 147, 294(b), 324, 427, 506(ii) of IPC and subsequently his name was deleted while filing charge sheet by the Sub Inspector of Police dated 29.08.2024. Thereafter, the petitioner participted in Group-IV examination and he was selected as Typist.
After certificate verification, the respondent passed the impugned order directing the petitioner to produce the court order. However, court order is not necessary for production since the petitioner himself was dropped while filing charge sheet. Hence, the impugned order has been passed in non application of mind. Accordingly, he prayed for appropriate orders.
3.
The learned Standing Counsel appearing for the respondent fairly submitted that in view of the discharge order passed by the Law Enforcement Agency against the petitioner, since the petitioner is no longer accused in the above case, this Court may set aside the impugned order by issuing direction to the respondent to provide appointment order to the petitioner forthwith. 4.
In view of the above submission made by the learned Standing Counsel appearing for the respondent, the impugned order is hereby set aside and there shall be a direction to the respondent to issue appointment order to the petitioner as expeditiously as possible.
5.
With the above direction, this writ petition stands allowed. No costs.
