This petition has been filed for seeking a direction to the respondents to give police protection to the petitioner.

2. Heard Ms.R.Deepa, learned counsel for the petitioner and Mr.P.Govindarajan, learned Additional Public Prosecutor for the respondents. By consent of both sides, this Criminal Original Petition is taken up for disposal.

3. The limited prayer sought for in the present petition is to direct the respondents to extend police protection to the petitioner. According to the petitioner, he apprehends trouble from one Palanisamy with regard to the peaceful enjoyment of property in Survey No.136, 136/A, 136/1A2 & 136/2 in Karuppur Village, Salem District.

4. In my view, the issue as to whether the police protection can be extended or not, is on the ground of reality and it is for the third respondent to consider the petitioner's request.

5. Hence, the petitioner is granted liberty to approach the third respondent to seek police protection and on receipt of such representation, the third respondent shall consider the same on its own merits and pass orders, within a period of four weeks from the receipt of the representation, after giving due opportunities to the rival claimants namely Palanisamy and all other interested parties.

6. With the above observation, the Criminal Original Petition stands allowed.
