The learned counsel for the plaintiff submitted that the suit was decreed in respect of 5/6th share of the suit property, for the relief of specific performance and this Court ordered to deposit the 'balance sale consideration' instead of ordering 'proportionate sale consideration' in respect of 5/6th share of the suit property.

3. Heard the learned counsel for the parties.

4. Considering the submission of the learned counsel for the plaintiff, this Court finds merits in his submission. Therefore, this Court modifies the direction to deposit the 'balance sale consideration' as the 'proportionate sale consideration' in respect of 5/6th share of suit property in para No.30 of the Judgment dated 03.01.2023. Registry is directed to carry out appropriate amendment in the Judgment.
