(RC MA 1 2009 A 0048) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the conditions made in pending appeal vide Crl.M.P.No.2216 of 2021 in Crl.A No.91 of 2021 i.e The First petitioner appellant shall report before the Trial Court on the First Working Day of Every English Calendar Month at 10.30 am until further orders, The Second petitioner Appellant shall report before the Trial Court once in three months on the First Working Day of the Particular month at 10.30 am until further orders.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.SHANKAR, Advocate for the petitioner and of MR.K.SRINIVASAN,Special Public Prosecutor for CBI Cases on behalf of the Respondent the court made the following order:- This petition is filed to relax the condition imposed on the petitioners in Crl.M.P.No.2216 of 2021 in Crl.A.No.91 of 2021 dated 24.02.2021.
2. The learned counsel for the petitioners submits that this Court while granting bail, imposed condition that the first petitioner shall report before the trial court on the first working
day of every English Calendar month at 10.30 a.m until further orders and the second petitioner shall report before the trial court once in three months on the first working day of the particular month at 10.30 a.m until further orders.
3. Learned counsel for the petitioners submits that the petitioners are complying with the condition regularly and the second petitioner is a chronic kidney patient and her right kidney was removed and she finds it difficult to comply with the condition. In support of his submission, the learned counsel has produced copies of medical records.
4. Insofar as the first petitioner is concerned, the learned counsel for the petitioners submits that the first petitioner is a senior citizen and he is aged about 69 years and he is complying with the condition imposed by this Court regularly and therefore, has filed this petition, seeking to relax the condition imposed by this Court.
5. Heard the learned Special Public Prosecutor for CBI Cases and he also submits that the petitioners have been complying with the condition regularly.
6. Considering the submission and also //taking note of the medical condition of the second petitioner, the condition imposed on the second petitioner is relaxed.
7. Considering the fact that the first petitioner is aged about 61 years and he is regularly complying with the condition imposed by this Court, the condition imposed by this Court on the first petitioner is modified to the effect that the first petitioner shall appear before the trial Court at 10.30 a.m on the first working day of once in three months of English Calendar month, commencing from 01.04.2022 until further orders and the condition imposed on the second petitioner is fully relaxed.
8.The petition is ordered accordingly.
