Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 3rd and 4th respondents to re-survey the property situated at Plot No.5, Survey Nos.183/2A and 184/1A, patta No.1601, reclassified in the new survey as Survey No.183/5, measuring an extent of 1307 sq.ft in Ammapalayam Village, Melmudiyanur Revenue Village, Chengam Taluk, Tiruvannamalai District with the aid of the 5th respondent and to provide protection within the timeline fixed by the Court. ORDER

This Writ Petition has been filed to direct the respondents 3 and 4 to re-survey and demarcate the property morefully disclosed in the prayer to this writ petition with the assistance of the 5th respondent, within a time frame to be fixed by this Court.

2. The petitioner claims that the earlier survey sought for by the petitioner for the very same property could not be completed on account Page No.2 of 6

of the obstructions made by third parties. In view of the same, the petitioner seeks for re-survey of the very same property with the assistance of the police, namely the 5th respondent.

3. Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4 and Mr.R.Venkatesa Perumal, learned Government Advocate (Crl.Side), accepts notice on behalf of the 5th respondent.

4. No prejudice would be caused to the respondents, if the respondents 3 and 4 are directed to re-survey and demarcate the boundaries of the petitioner's property morefully disclosed in the prayer to this writ petition, after hearing the objections, if any, from the neighbouring land owners as well as any other party whom they deem fit to put on notice within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the respondents 3 and 4 are directed to issue notice to the neighbouring land owners, and also to any other party, if they deem fit to put on notice.

(b) After receiving objections if any and after considering the same, the respondents 3 and 4 shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

(c) If the need arises for police assistance and on a request made by the respondents 3 and 4, the 5th respondent shall render police assistance for the effective implementation of this order.

(d) There shall be no order as to costs.
