Cr.No.649 of 2025.
..Respondent(s) Prayer: This Criminal Original Petition is filed under Section 483 of BNSS to enlarge the petitioner on bail, pending investigation of the case in the Cr.No.649 of 2025 on the file of the Respondent.
For Petitioner(s):
Mr.M.Vijaya Ragavan For Respondent(s):
Dr.C.E.Pratap, GA (Crl.Side)
ORDER
The petitioner, who was arrested and remanded to judicial custody on 24.12.2025 for the offences punishable under Sections 80, 81, 87 of Juvenile Justice (Care and Protection of Children) Act, 2015 and under Section 143(1)(f) of BNS, 2023 in connection with Crime No.649 of 2025.
2. The allegations against the petitioner is that the first and second accused had sold their child to the eighth and ninth accused, and the petitioner,
who is arrayed as A5, had acted as a mediator in facilitating the said illegal acts and alleged to have derived unlawful gain. Hence, the present case has been registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case. It was further submitted that the petitioner has been in judicial custody since 24.12.2025 and that she is willing to abide by any stringent conditions that may be imposed by this Court. Hence, the learned counsel sought for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent police, on instructions, submitted that there are totally nine accused involved in this case and the petitioner is arrayed as A5. It was further submitted that victim child has been rescued and the investigation is still pending. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.
5. This Court has carefully considered the submissions made on either side and perused the materials on record.
6. Considering the nature and gravity of the offence, the overt act attributed to the petitioner and the stage of investigation, this Court is of the
view that if anticipatory bail is granted to the petitioner, there is a likelihood of the petitioner indulging in similar offences. Therefore, I am not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed. 20-02-2026 Index: Yes/No Speaking/Non-speaking order gbi To
