ORDER

[Order of the Court was made by M.SUNDAR, J.,] Mr.V.Ramana Reddy, leaned counsel for writ petitioner, who is before us, adverting to 21.10.2024 proceedings expresses regret for missing the matter in the previous listing before another Hon'ble Division Bench.

2. Be that as it may, as regards the captioned matter, learned counsel notwithstanding the expansive prayer abridges the same in the Page Nos.2/9

hearing and submits that it will suffice if petitioner's representation dated 21.10.2020 is considered by R2.

3. Mr.G.T.Subramanian, learned standing counsel for Chennai Corporation (R1 and R2) is before us. R3 (private respondent) has entered appearance through counsel (Mr.J.Kamaraj and co-counsel), names of the counsel and co counsel are duly shown in the cause list but there is no representation.

4. Owing to the abridged prayer, as we can dispose of the WP preserving the rights of the third respondent and therefore, we proceed to do the same by taking up the WP with the consent of both sides.

5. Representation dated 21.10.2020 as placed before us is as follows:

6. In the light of the abridged prayer which is being made by learned counsel for writ petitioner, R2 (The Assistant Commissioner (South), The Greater Chennai Corporation, Zone XIV, Puzhuthivakkam, Chennai - 600 091) shall now consider the aforementioned Page Nos.5/9

representation dated 21.10.2020 on its own merits, in accordance with law and dispose of the same as expeditiously as the business of R2 would permit but in any event within six weeks from today i.e., by 17.12.2024.

7. Be that as it may, we make it clear that R2 while disposing of the aforementioned representation, shall requisition response of R3 and take into account the version of R3. This is the safety valve we are putting in as regards R3. We make it clear that all the rights and contentions of the writ petitioner as well as R3 are preserved for the purpose of R2 to dispose of the representation on its own merits and in accordance with law within the time frame that has been set out supra.

8. Captioned WP is disposed of in the aforesaid manner. No costs.
