This petition has been filed to grant special leave to the petitioner herein to prefer an appeal against the judgment dated 18.12.2020 made in Crl.A.No.77 of 2018 on the file of the learned III Additional Sessions Judge, Villupuram @ Kallakurichi.

Heard the learned counsel appearing for the petitioner. 3.
The findings arrived at by the trial Court in respect of sending statutory notice, is against the observation made by the Hon'ble Supreme Court in a case of RAJNEESH AGGARWAL vs. AMIT J.BHALLA reported in (2001) SCC 631. In otherwise, on the side of the accused, in respect of the signature found in the cheque, there was no denial.

Hence, in view of the above, the petitioner shown a prima facie case for filing an appeal. Accordingly, leave granted and petition is allowed.
