The petitioner appeared for teachers eligibility test conducted by the second respondent after passing M.A.(Tamil) and M.Phil but she was not selected. Aggrieved over the same, she has preferred the above writ petition. The reason for the non selection according to the petitioner was that she had passed B.A (Applied Tamil) and whereas, this eligibility test was conducted only for Tamil and therefore, the analogy adopted by the recruitment Board is erroneous.
2.From the perusal of the records it is noted that the petitioner has passed B.A. Degree Applied Tamil and secured 95 marks in the eligibility test. Had she passed B.A.Tamil she could have been declared as an eligible candidate but the respondents for the reasons best known have not selected her on the ground Applied Tamil is not equivalent to B.A Tamil. But it is noted that after passing B.A. Applied Tamil, the petitioner was appointed to the post graduate Course and passed M.A.Tamil and obtained M.Phil decree also. Therefore, the non selection of this petitioner on the basis the Course is not correct. But what is challenged in the writ petition is only with regard to eligibility to participate in the test and not against recruitment.
The petitioner does not come out with specific case that in the process of recruitment she was deprived of any appointment. Now that the Government themselves have corrected the same by issuing G.O that B.A Tamil and B.A.Applied Tamil are equivalent and anybody appearing for the test and who secure the required mark will be considered as eligible. Therefore, it goes without saying the petitioner is eligible to be considered in the recruitment of teachers. Considering the same, the respondents 1 to 3 are directed to consider the petitioner for selection and appointment of teacher in the future recruitment to be made.
3.With these observations, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition stands closed.
