PRAYER: Civil Revision Petitions filed under Article 227 of the Constitution of India with a prayer to dispose the O.P.No.3984 of 2015 and O.P.No.1465 of 2017 pending on the file of I Additional Family Court at Chennai. For Petitioner :

Mr.T.Karunakaran COMMON ORDER The respondent / husband has filed a petition for restitution of conjugal rights in O.P.No.3984 of 2015, which is pending on the file of First Additional Family Court, Chennai. Since the respondent / husband is not cooperating with the proceedings, the petitioner / wife is before this Court seeking for an early disposal of the petition.

2. It is stated that the petitioner has filed a petition for maintenance in M.C.No.24 of 2017 and another petition in O.P.No.1465 of 2017 for divorce. After filing the petition for restitution of conjugal rights, both the parties have jointly filed a petition for divorce on mutual consent, which was later dismissed, since the husband has retracted from the same.

3. The learned counsel for the petitioner would submit that the number of Family Court has been doubled and therefore, a direction may be given to dispose of the matter expeditiously.

4. This Court finds that M.C.No.24 of 2017 and O.P.No.1465 of 2017 are filed very recently and the same are now in preliminary stage. At this stage, it is not proper to direct the Court below to dispose of the case within a period of three months. Therefore, without going into the merits of the case, a direction is issued to the First Additional Family Court, Chennai, to dispose of M.C.No.24 of 2017; O.P.No.1465 of 2017 and O.P.No.3984 of 2015, as expeditiously as possible, after completion of all the processes.

5. With the above observation and direction, both the Civil Revision Petitions are disposed of. No costs. 28.08.2017 Index : Yes/No Internet : Yes/No TK To The First Additional Family Court Chennai.
