ORDER

This Civil Revision Petition has been filed seeking a direction to the Sub Court, Kancheepuram to dispose of the H.M.O.P.No.174 of 2021 as expeditiously as possible.

2.The petitioner/estranged husband of the respondent filed H.M.O.P.No.174 of 2021 seeking divorce on the ground of cruelty. The learned counsel for petitioner submitted that the case is progressing at a snail space. The respondent for some reason or other willfully delaying the proceedings and three years have pass by, despite, the case was periodically adjourned. From the E-Court on-line case status it is seen that from 22.06.2023, the case is pending at part-heard stage. Finally, the petitioner was examined on 14.12.2023 and marked Exs.P1 to P7. For cross examination it was adjourned to 22.02.2024, on which day also no cross examination done. Finally on 25.04.2024, recording as no further adjournment the case was adjourned during June, 2024 and finally it is posted to 11.07.2024 at the same stage. The petitioner is regularly appearing before the Family Court, subjecting himself for cross examination but the respondent not conducted any cross examination. The Family Court also periodically adjourning the case at the request of the respondent, which is not proper. 2/4

3.Since it is only a limited prayer seeking direction to dispose of H.M.O.P.No.174 of 2021 within the stipulated period, notice to the respondent not required. Hence, notice to the respondent dispensed with. 4.In view of the same, this Court directs the trial Court (Subordinate Court, Kancheepuram) to dispose of the H.M.O.P.No.174 of 2021 within a period of three months from the date of receipt of a copy of this order.

5.With the above directions, the Civil Revision Petition is disposed of. No costs.
