ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.12.2025, for the alleged offence punishable under Sections 5(l), 5(j)(ii), 5(k) r/w. 6(l) of the Protection of Children from Sexual Offences Act, 2012 in Crime No.27 of 2025 on the file of the respondent police, seeks bail.

The allegation against the petitioner is that he committed aggravated penetrative sexual assault on the victim girl aged about 15 years who is already 40 percent mentally retarded and this assault was taken place for some time, and which resulted in causing pregnancy and during school hours she suffered illness later she was taken to hospital and from there it was revealed that the victim has suffered penetrative sexual assault by the petitioner herein. Hence, the case has been registered.

3.The learned counsel for the petitioner submitted that the petitioner has not committed aggravated penetrative sexual assault and it is alleged that the assault on the victim has been recorded and videographed and now the phone is also recovered and it was not recorded by the petitioner and is ready to cooperate with the investigation. Hence, he prayed for grant of bail to the petitioner.

The Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that victim has elaborately narrated the incident while recording the statement under section 183(5) of BNS and the investigation is pending. Hence, he opposed for grant of bail to the petitioner.

5. I have gone through the statement recorded from the victim girl aged

about 15 years and she has narrated various incidents including the way in which she was subjected to aggravated penetrative sexual assault by the petitioner herein, this Court is not inclined to grant bail to the petitioner.
