O R D E R

This petition has been filed to call for the records in C.C.No.3836 of 2012 on the file of the learned IX Metropolitan Magistrate, Saidapet, Chennai and quash the same.

2. Heard the learned counsel for the petitioners and the learned counsel for the respondent.

3. The learned counsel appearing for the respondent / complainant has submitted that the dispute between the petitioners and respondent has been amicably settled before the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, which was also reduced in writing.

4. The terms of agreement have been filed before the Mediation Centre, which reads as follows:

"Both sides, out of their own volition and without any pressure or coercion from any side have agreed as follows:

1. The 1st petitioner agreed to come and sign in the relevant records for the cancellation of the Joint Operation of Bank Locker and Savings Bank Account at https://hcservices.ecourts.gov.in/hcservices/

Axis Bank, Velachery Bye-Pass Road Branch on or before 15.03.2014.

2. The petitioners agreed to return silver articles and dress of the respondent's daughter.

3. The petitioners and respondents declare that they have no claim whatsoever in respect of gold jewels and brass materials.

4. The respondent agreed to withdraw the case in C.C.No.3836/2012 pending on the file of the learned IX Metropolitan Magistrate, Saidapet, Chennai -15.

5. Both parties agree that they have no further claim against each other including on behalf of the daughter of the respondent."

5. The learned counsel for the respondent has submitted that the respondent agrees to withdraw the case in C.C.No.3836 of 2012 pending on the file of the learned IX Metropolitan Magistrate, Saidapet, Chennai.

6. In view of the above submission of the learned counsel for the respondent, this Criminal Original Petition is allowed. The terms of the agreement shall form part of the order.
