This petition is filed to condone the delay of 631 days in filing the revision as against the maintenance order dated 15.02.2018. When the matter came up for hearing, the learned counsel appearing for the respondent submitted that as on date, there is arrears of more than Rs.80,000/- (Rupees Eighty Thousand only).

2. Considering the fact that by a common order, the Trial Court has disposed of the original petition for divorce and also the maintenance case and since the Civil Miscellaneous Appeal is said to have been pending as against the order in the original petition, I am of the view that the delay can be condoned, but, however, on condition that the petitioner shall deposit atleast 50% of the arrears amount. Therefore, the petition is allowed and the delay is condoned on condition that the petitioner shall directly pay to the first respondent by way of a demand draft or by RTGS/NEFT transfer a sum of Rs.40,000/- (Rupees Forty Thousand only) on or before 05.08.2022.
