ORDER

The petitioner, who apprehends arrest at the hands of the respondent police in execution of Non Bailable Warrant issued by the learned Judicial Magistrate, Ambattur in C.C.No.424 of 2003 relating to Crime No.462 of 2002 on the file of the respondent police registered for the alleged offence punishable u/s 447, 427 and 506(ii) of IPC, seeks anticipatory bail.

2. The learned Additional Government Pleader would submit that a non bailable warrant has been issued against the petitioner on 09.03.2021 due to his non appearance and the same has been pending for execution.

3. Considering the fact that Non Bailable Warrant has been pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner is directed to surrender before the learned Judicial Magistrate, Ambattur, within a period of two weeks from the date of receipt of the copy of this order with a petition under Section 70(ii) of Cr.P.C. to recall the non bailable warrant issued against him. On filing of such petition, the learned Magistrate is directed to consider the same on merits and pass appropriate orders on the same day.
