A.No.2307 of 2024 in TOS.No.3 of 1971 P.B.BALAJI, J., This application has been filed to set aside the order dated 15.06.2023 and restore A.No.2079 of 2023 in TOS.No.3 of 1971 which was dismissed for non-prosecution by this Court.

2.I have heard Mr.P.Kannankumar, learned counsel for the applicant.

3.I have gone through the affidavit filed in support of the application and being satisfied with the reasons assigned in the affidavit filed in support of the application and the respondents also not contesting the Testamentary Original Suit, this application is allowed and the order dated 15.06.2023 is set aside and consequently, A.No.2079 of 2023 is restored to file.
