The petitioner/accused who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 363, 366 of IPC and Section 3 read with 4 of POCSO Act and 9 & 11 of Prohibition of Child Marriage Act 2006, seeks anticipatory bail.
2. It is the case of the prosecution that the victim child had developed relationship with the first accused and the present petitioner was also present when the first accused had married the victim child. Later, the first accused also had physical relationship with the victim child. The statement of the victim child had been examined by this Court, where the name of the petitioner is also reflected.
3. The earlier application seeking anticipatory bail in Crl.O.P.No. 64 of 2024 was dismissed on 19.01.2024. There are no change in circumstance. The first accused is still in custody. I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Petition stands dismissed.
