Respondent Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the Respondent Service Commission to include the name of the petitioner in the select list published in the official web-site of the respondent commission on 10.11.2012, by confirming the selection of the petitioner on merit, for the posts included in the Group-IV services examination 2007-08 to 201213, notified in Advertisement No.14/2012 dated 27.04.2012, on considering the marks scored by the petitioner in consonance with the cut-off marks for the relevant category, in order to initiate further selection process and consequently to recommend the selected petitioner to be appointed as Typist or any other post pertaining to the petitioner in

the said Group-IV Services Examination 2007-08 to 2012-13, with due seniority and all service benefits.

ORDER

This Writ Petition has been filed for direction directing the respondent to include the petitioner's name in the selection list to the post of Typist or any other post in the Group-IV service examination.

The petitioner had applied for the post included in the Group -IV service examination, as per the Advertisement No.14/2012 dated 27.04.2012, inviting application for the direct recruitment to fill up nearly 10,718 vacancies in various post included in the Group-IV and Group -VIII services examination. The petitioner had passed senior grade examination in Typewriting, in both Tamil and English. Therefore, she is qualified by Educationally and technically and applied for the said examination. She attended the examination. In the result, the petitioner's Register number was not found and she was not called for certificate verification.

3. Later, she came to know that other candidate was appointed as Junior Assistant, who had obtained lesser mark than her. The petitioner had scored 213 marks in the written examination. The cut off mark for the post of Typist for MBC Category is lesser than the marks scored by the petitioner. Therefore, she submitted a representation to include her name in the selection list.

A perusal of the counter filed by the respondent revealed that the technical qualification i.e., Typing and Stenography of 658 candidates have not registered in the on-line application due to some technical problem. Therefore, they were not considered for selection. However, the respondents had decided to consider those candidates and conducted certificate verification on 28.01.2013, in which about 473 candidates had attended the certificate verification held from 28.01.2013 to 31.01.2013. Subsequently, 201 candidates had been selected for the post of Typist among 473 candidates. In fact, the petitioner had attended the certificate verification on 28.01.2013. However, she was absent on the date of counselling held on 29.04.2013. She was duly informed about

the counselling to be held on 29.04.2013 by the respondents through the memo dated 17.04.2013. However, the petitioner was absent on the date of counselling and as such, she was not included in the selection list.

5. Therefore the prayer sought for in this writ petition cannot be considered and this writ petition is devoid of merits and is liable to be dismissed.
