[Made by S.M.SUBRAMANIAM, J.,] The writ of mandamus has been instituted seeking a direction to the respondents 1 to 6 to consider the representation dated 04.03.2021 submitted by the petitioner for removal of encroachments. Page Nos.2/5
2. The learned counsel for the petitioner would submit that the Government Poromboke land has been encroached upon by the respondents 7 and 8 and that despite the complaint given by the petitioner, no action has been taken by the authorities. Thus, the present writ petition came to be instituted.
3. The learned counsel for the respondents 7 and 8 would oppose by stating that a portion of the land belongs to them and that they are pattadars and therefore, the complaint filed by the petitioner is incorrect.
4. The learned Additional Government Pleader for the respondents 1 to 6 submits that the authorities would conduct a survey and initiate appropriate actions in the manner known to law.
5. Considering the arguments advanced by the parties, this Court directs the 5th respondent to conduct an inspection and survey of the said land, identify the encroachments, if any and thereafter initiate enforcement action by following the procedure contemplated under the relevant Statutes and Rules in force. Such exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. Page Nos.3/5
With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
