Mr.T.Padmanabhan JUDGEMENT Today, when the matter taken up for hearing, both the learned counsel appearing for the appellant and respondent appeared and submitted that the matter is settled out of court. Accordingly, the appellant paid a sum 1\3
of Rs.17,00,000/- (Rupees seventeen lakhs only) towards full and final settlement and in turn, the respondent returned all the original documents. To that effect, a memo was filed by both the parties.
2. Memo filed by the appellant is recorded. In view of the same, this Appeal Suit is dismissed as settled out of court. The Registry is directed to refund entire court fee to the appellant and the trial court is directed to refund the court fee less 25% to the plaintiff within a period of two weeks from the date of receipt of copy of this order respectively. Furthermore, since the matter was settled amicably between the parties, the Sale Agreement dated 09.12.2013 is ordered to be cancelled and the same is to be intimated to the concerned Sub-Registrar Office and remove the said encumbrance from mutation of records as per manner known to law.
