Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the impugned orders passed by the 3rd respondent vide proceedings dated 12.09.2023 and subsequent impugned notice issued by the 2nd respondent in Proceedings dated 16.02.2024 and QUASH the same and consequently direct the respondents to refund the excess amount paid by the respondent by removing petitioner name on respondents ledger entry for water connection. ORDER

The learned counsel for the respondents submits that, in view of the impugned demand notices issued in Form I dated 12.09.2023 and 16.02.2024 fresh orders would be passed after considering the petitioner's representation.

2. Recording the above submission made by the learned counsel for the respondents, the impugned demand notices are quashed and the case is remitted back to the second respondent / Senior Accounts Officer - 5 to pass a fresh order on merits.

3. The petitioner shall file a proper representation furnishing all necessary particulars, before the second respondent / Senior Accounts Officer - 5 within a period of 30 days from the date of receipt of a copy of this order.

4. Upon such filing of the representation, the second respondent / Senior Accounts Officer - 5 shall consider the same and pass a final order on merits and in accordance with law, as expeditiously as possible.
