ORDER : The Court Made the following order :- The petitioner herein apprehends arrest on the complaint dated 24.01.2022 for the alleged offence under Sections 448, 427, and 506(2) I.P.C. is before this Court.
2.Earlier, when the Court was not inclined to grant anticipatory bail sought for by the petitioner, the petitioner withdrew the earlier petition on 11.02.2022. This is the second anticipatory bail petition filed by the petitioner for the very same relief. 3.Learned Public Prosecutor states that the petitioner herein taking advantage of the absence of the neighbouring landlord had demolished their house and started to put up construction in their land. When the defacto complainant came to know about the same, they have started to threaten the defacto complainant. Since the defacto complainant is a senior citizen aged about 91 years, he was not able to prevent the aggression of the petitioner had given a complaint to the Revenue authorities to measure the land and to protect the land, but the representation to the revenue authorities went in https://hcservices.ecourts.gov.in/hcservices/
vain. Taking advantage of the age and Pandemic situation, the petitioner herein started to harass the defacto complainant and threatened him with dire consequences. When the Investigating officer went to the house of the petitioner for the investigation, the petitioner herein absconded. He added that unless the petitioner is secured, the investigation in this case cannot be proceeded and in order to give proper justice to the senior citizen, the appearance of the petitioner is very much required.
3.In view of the above submission made by the Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner. This Criminal Original Petition stands dismissed accordingly.
