Seeking leave to sue the second respondent / second defendant, the applicant/plaintiff has come up with this application.
2. Mr.Narendran, learned counsel for the applicant would submit that the suit is filed for discharge the performance bank guarantee and for recovery of money. The learned counsel would further submit that the entire cause of action arose within the jurisdiction of this Court and this application is filed since the second defendant-Bank is situated in Udumalpet, Tirupur District, which is situated outside jurisdiction of this Court and it is further contended that the second defendant is only a formal party and no relief is sought against the second defendant.
3. Considering the submission made by the learned counsel for the applicant and also considering the averments made in the plaint, leave is granted.
