This petition has been filed, seeking a direction to the second respondent to file report with respect of Crime No.241/2012, pending on the file of the second respondent within a reasonable period.
2. It is submitted by the learned counsel for the petitioner that initially the case was registered in Crime No.241/2012, on the file of the Inspector of Police, Bagalur Police Station, Krishnagiri District for the offence under Section 420 IPC and by order dated 06.11.2013 made in Crl.O.P.No.22413/2012, the investigation was transferred to Inspector of Police, Economic Offence Wing and this
Court directed the Inspector of Police, Economic Offene Wing, Krishnagiri District Zone to continue the investigation in Crime No.241/2012, collect the evidence, trace the culprits including seizing of properties and file the final report before the jurisdictional Magistrate at an early date. It is further submitted that though 18 months had lapsed, no final report was filed and therefore, this petition is filed.
3. The learned Additional Public Prosecutor representing the respondents-Police submitted that the sole accused in this case died and therefore, there was no progress and having regard to the properties purchased by the deceased/sole accused by utilizing the money collected from the depositors, the Investigating Agency is collecting details and they would file the final report within a reasonable time.
4. Considering the fact that the alleged accused person died and the charge abates and that the respondent police have to ascertain the properties acquired by the deceased/sole accused by utilizing the money collected from the depositors, for distribution to those persons, this Criminal Original Petition is disposed of with a direction to the second respondent to collect the details with regard to the properties purchased by the deceased/sole accused and submit a report within a period of six months from today.
