O R D E R
This Criminal Original Petition has been filed to call for the records and quash the entire proceedings in C.C.No.28 of 2022 in F.I.R.No.307 of 2015 on the file of the learned Judicial Magistrate, Sholingar.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent Police and perused the materials available on record.
3. Learned Additional Public Prosecutor appearing for the respondent police submitted that trial has been commenced and except the Investigating Officer, all other witnesses have been examined. The case is listed today for examination of the Investigating officer.
4. On a perusal of the charge sheet and statements recorded under Section 161 Cr.P.C., prima facie materials are available to proceed with the case further. The grounds raised by the petitioner are matter for trial
and the same can be decided only after completion of trial. This Court does not find any merit in this petition.
5. In view of the same, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. However, the petitioner is at liberty to take all his defence before the trial court.
