Respondent Prayer: This Writ Petition is filed under Article 226 of the Constitution, praying for the issuance of Writ of Certiorarified Mandamus, to call for the records of the respondent in its Rc.No.258/444/NGB.V(1)/P-10/C list 2016-2017/2017 dated 12.4.2017 and quash the same in so far as it does not include the petitioner's name at the appropriate place and consequently direct the respondent to include her name for promotion as Inspector of Police for the year 2016-2017 in the light of the representation made by her on 24.4.2017.

ORDER

The petitioner has approached this Court, seeking the following relief:

"to issue a Writ of Certiorarified Mandamus, to call for the records of the respondent in its Rc.No.258/444/NGB.V(1)/P-10/C list 2016-2017/2017 dated 12.4.2017 and quash the same insofar as it does not include the petitioner's name at the appropriate place and consequently direct the respondent to include her

name for promotion as Inspector of Police for the year 2016-2017 in the light of the representation made by her on 24.4.2017."

The case of the petitioner is that she was appointed as Sub Inspector of Police, pursuant to the examination conducted by the Tamil Nadu Uniformed Services Recruitment Board for the year 2001-2002. Thereafter, she was deputed for training at Police Training College, Perurani, Tuticorin district. She has successfully completed her training and secured 910 marks out of 1200 marks and her seniority has been assigned based on the marks secured by her. According to the petitioner in 2016, nearly 220 persons were promoted to the Inspector of Police. At that time, the petitioner did not have any grievance since those promotees promoted were all seniors to the petitioner. However, on 12.04.2017, nearly 104 persons were promoted as Inspector of Police and all of them, according to the petitioner were her batch mates.

The case of the petitioner is that the persons promoted vide order dated 12.04.2017 have secured lesser marks in the Sub Inspector training than the petitioner and their promotion was clearly overlooking the seniority of the petitioner. In such circumstances, the petitioner has submitted a representation to the respondents on 24.04.2017. However, as there was no response forthcoming from the respondent, the petitioner has approached this Court to set aside the impugned order passed by the respondent.

Mr.N.Balamuralikrishnan, learned counsel for the petitioner would submit that the petitioner would be satisfied if a direction is issued to the respondent to dispose of the representation made by the petitioner on 24.4.2017 highlighting her grievances as against the impugned order passed by the respondent, promoting many of the juniors of the petitioner.

4. Mr.L.Jayaprakash Narayan, learned Special Government Pleader takes notice on behalf of the respondents.

5. On consideration of the facts and circumstances and in view of the limited prayer now sought for by the learned counsel for the petitioner, this writ petition itself is taken up at the admission stage itself and being disposed of with the following direction.

"The respondent is directed to consider and dispose of the representation made by the petitioner on 24.04.2017 as against impugned order passed by the respondent dated 12.04.2017 by passing appropriate orders therein on merits and in accordance

with law, within a period of six weeks from the date of receipt of a copy of this order."
