M/s.V.Shenaz, the learned counsel appears for the first respondent. The learned counsel for the petitioner / appellant has made an endorsement seeking permission to dispense with the notice to the second respondent, who remained exparte in the court below.
2. In the light of the endorsement made by the learned counsel, notice to the second respondent is dispensed with. This miscellaneous petition has been filed to condone the delay of 5 days in filing the civil miscellaneous appeal against the fair and decretal order passed by the learned Additional District Judge, Namakkal in IA.No.4 of 2021 in OS.No.168 of 2021 dated 15.09.2022.
3. I have gone through the affidavit filed in support of the petition and I am satisfied with the reasons stated therein. Accordingly, this miscellaneous petition is allowed and the delay of 5 days in filing the appeal is condoned.
