ORDER

This application has been filed by the applicant/plaintiff seeking to sue the respondents 1 / defendant 1 who is residing outside the jurisdiction of this Court.

2. According to the applicant, he is the plaintiff in the main suit and filed the suit for the relief of declaration. Already they sought leave sue against the defendants 3 to 6 who are residing outside the jurisdiction of this Court. At the time they omitted to seek leave to sue as against the first defendant who is residing outside the jurisdiction of this Court. Therefore, filed this application.

3. This Court heard petitioner side and perused the records.

4. Considering the reasons stated in the affidavit that the first defendant is also residing outside the jurisdiction of this Court. Already this Court granted leave sue to against the defendants 3 to 6, it is appropriate to allow this application and therefore, leave is granted as prayed for.

5. Accordingly, this application is allowed.

6. The Registry is directed to number the suit, if it is otherwise in order.
