ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under sections 294(b), 324, 506(i) in Crime No.219 of 2022 seeks anticipatory bail.

2. The FIR indicates that one Kamalanathan was brutally attacked by this petitioner with iron rod over his face causing grievous injury near left eye and face. Hence, the petitioner seeks anticipatory bail apprehend arrest in this case.

3. The learned counsel for the petitioner submits that for the alleged occurrence took place on 20.02.2022 and the FIR was registered only on 13.03.2022 and in the CSR stage, the petitioner was co-operated with the investigation and now also ready to cooperate with the investigation. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) submits the Accident Register which indicates that one Kamalanathan who is the son of the defacto complainant was sustained grievous injury, due to the assault caused by the petitioners, injury in left eye and face bleeding from nose laceration over left eye and periorbital swelling in left eye. Hence, he opposed the grant of anticipatory bail to the petitioners.

Taking note of the fact that there was persistant enmity between the defacto complainant and the petitioners and they were causing nuisance to the defacto complainant by scaling his house and throwing ball on the defacto complainant and his wife. Earlier, they have also damaged the car of the injured Kamalanathan, when he questioned about them, they attacked him with lethal weapons.

6. Considering the allegations against the petitioners, the grant of anticipatory bail to the petitioners may embolden them to threaten the defacto complainant's family member. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
