Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus or any other appropriate Writ, Order or Direction in the nature of a Writ, calling for the records relating to the orders issued in proceeding R.C. No.A2/eOffice 28437/2022 dated 22.07.2022 passed by the 1st respondent and quash the same and direct the respondents to reinstate the petitioner into service with all consequential benefits.

ORDER
This Writ Petition has been filed in the nature of a certiorarified Mandamus seeking records relating to an order dated 22.07.2022, by 1/4
which order the first respondent had placed the petitioner under suspension, and to quash the same.
2. The petitioner was recruited through Tamil Nadu Public Service Commission (TNPSC) and was working as a Revenue Inspector at Thiruvannamalai. Owing to a complaint lodged of demand of bribe, further steps were taken by the Vigilance and the petitioner was, according to the respondent, caught red handed while demanding and accepting the bribe amount. Thereafter, an FIR in Crime No.9/2022 had been registered against the petitioner. The petitioner was remanded to custody on 20.07.2022 and released on bail after 20 days on 09.08.2022. Taking into consideration the seriousness of offence, by the impugned order, the petitioner was placed under suspension. The petitioner made a representation on 01.08.2024 to the respondent for revocation of her suspension. Since the same has not been considered by the respondent, the present Writ Petition has been filed.
3. It is contended that investigation is still in progress and final report has not yet been filed. At this stage it would cause great prejudice to the on going investigation and also to the departmental proceedings, if 2/4
contemplated, if the petitioner's suspension is revoked. But, however, after filing of the final report, the petitioner may give a representation and if so given, the respondent may examine the same according to the circumstances which prevails at that particular point of time. At this point of time, I am not inclined to revoke the suspension.
4. It is also seen from the records that the petitioner had given a representation seeking to revoke the suspension. The respondent may take a decision on the same, but it would only be advisable that a final report is filed in the Criminal case by the Vigilance.
5. With the above directions, this writ petition stands disposed of. No costs. W.M.P. No.7406 of 2025 which was filed to dispense with the production of the impugned proceedings, stands allowed. Consequently connected miscellaneous petition is closed.
