Respondents Writ petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, to direct the 2nd respondent to approve the Patta No.213 issued by the Special Tahsildar, Natham Nilavari Thittam dated 24.04.1990 completing the enquiry based on the reference in Na.Ka.No.1073/2017/A2 dated 11.03.2017 within stipulated time.

Mr.P.Senthilvel, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. It appears that in respect of patta already issued in favour of the petitioner, an enquiry is pending before the second respondent and the same has not been completed by passing a final order so far. Ventilating such grievance, the petitioner has made a representation on 21.08.2017.

4. Therefore, this Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the second respondent to consider and decide the same on merits and in accordance with law. Accordingly, this writ petition is disposed of, only by directing the second respondent to consider the representation of the petitioner dated 21.08.2017 and pass orders on the same on merits and in https://hcservices.ecourts.gov.in/hcservices/

accordance with law. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
