The Criminal Original Petition has been filed to direct the 1st and 2nd respondents to provide necessary police protection based on the complaint dated 11.03.2022 given by the petitioner.
2. Learned counsel appearing for the petitioner would submit that the petitioner was married to the 3rd respondent on 21.08.2005 as per the Islamic rights and out of the wedlock, the petitioner has begotten two male children. However, due to the https://hcservices.ecourts.gov.in/hcservices/
harassment metted out by her husband, she has left her matrimonial home of her own accord. However, on a false complaint given by the 3rd respondent that the petitioner is missing, the respondent police are harassing her. Thereby, the present petition has been filed seeking for police protection.
3. Learned Additional Public Prosecutor would submit that the petitioner is a married woman and her husband one Santhu Mohamed/R3 had given a complaint stating that the petitioner is missing from the matrimonial home. Based on the complaint given by the 3rd respondent, a case in Crime No.135 of 2022 has been registered in the caption ''Woman Missing'' and other than searching for the petitioner, the respondent are not harassing the petitioner. He would further submit that if the petitioner appears before the respondent, due protection will be given to her and she is being a major adult, she is entitled to live on her own will. The respondent are not harassing her and if necessary, appropriate protection will be given to the petitioner.
4. Recording the same, this Criminal Original Petition stands disposed of.
