This application has been filed to permit the Applicant/Defendant to produce Additional documents in the above suit C.S.No.98 of 2021 pending on the file of this Honble Court.

It is submitted by the learned counsel for the applicant that these three documents are vital documents which are essential for proper adjudication of the issues involved in the suit and it directly contradicts the oral and documentary evidence of plaintiff and PW2 and sought for allowing this application. 3.

Learned counsel for the respondent, on the other hand, has raised objection in allowing this application stating that this application has been filed after the examination of PW2 and sought for dismissing this application. 4.

It is seen from the records that document no.2 is the original of a collateral security for loan amount RM 500000 and document nos.1 & 3 are e-mail copy dated 07.03.2018 and screenshot picture. Though, it is contended that this application has been filed after the completion of the examination of PW2, it is submitted by the learned counsel for the applicant that these documents would be marked through the remaining witnesses of the defence side. Hence, this Court is inclined to allow this application since this case is of the year 2021 and the trial has to be proceeded with and no prejudice would be caused to the respondent. 2/4

Accordingly, considering the reasons stated in the affidavit filed in support of this application, this application is allowed subject to proof, relevancy and admissibility. No costs.
