Respondents Prayer: Petition filed under Section 11 of the Contempt of Courts Act, 1971, seeking directions to punish the respondents herein for having committed contempt of the orders passed by this Hon'ble High Court in W.P.No.29662 of 2023 dated 12.12.2023 by not implementing the order.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.S.T.Rajesh Murugan, learned counsel for the petitioner and Mr.P.Harish, learned Government Advocate for the respondents.

2. Learned counsel for the petitioner submits that the order of this court dated 12.12.2023 is not complied with. The encroachment has not been removed.

3. The learned Government Advocate submits that on 29.12.2023, survey was conducted, however the petitioner raised objections. Now, the authority has directed for resurvey of the land under his communication dated 13.02.2024.

4. Learned counsel for the petitioner submits that only the land in S.No.247 was surveyed and the land in S.No.231 was not surveyed, as such, objections were raised.

5. Be that as it may, now fresh survey has been directed. Fresh survey shall be conducted within a period of six weeks and depending upon the report of the survey, further steps, in accordance with law, shall be undertaken preferably within a period of four months from today.

6. The present contempt petition, accordingly, stands disposed of. There shall be no order as to costs.
