Crl.M.P.(MD) No.2195 of 2024 in Crl.O.P.(MD) No.16834 of 2017 N.ANAND VENKATESH,J This is a petition filed by the petitioners seeking to modify the order dated 11.12.2023 passed in Crl.M.P.(MD) No.4762 of 2023 in Crl.O.P.(MD) No.16834 of 2017 and consequently direct the first respondent to file the charge sheet without arraying the petitioners as accused in view of the payment made by them.
2. Heard the learned Senior Counsel appearing on behalf of the petitioners and the learned Additional Public Prosecutor appearing for the first respondent.
3. The said criminal original petition was filed by the petitioners seeking to quash the first information report in Crime No.698 of 2017 on the file of the first respondent. During the pendency of the said quash petition, the matter was referred to the Mediation Centre and the parties were able to come to some understanding. Further, a portion of the amount was also settled by the petitioners to the defacto complainant. Hence, the said quash petition was disposed of by order dated 13.9.2022 granting some time to the petitioners to settle 1/4
the balance amount to the defacto complainant.

As the balance amount was not settled by the petitioners within the time limit fixed by this Court in the said quash petition, the petitioners filed Crl.M.P.(MD) No.4762 of 2023 seeking for extension of time to comply with the said order dated 13.9.2022 passed in the said quash petition. This Court also, by order dated 10.11.2023, extended time by four weeks. Thereafter, the matter came up for hearing on 11.12.2023. At that point of time, it was informed that the accused persons did not come forward to settle the entire balance amount. This Court was not satisfied with this explanation offered on behalf of the petitioners and therefore, directed the first respondent - police to proceed further with the investigation and complete the investigation within a period of three months. Now, Crl.M.P.(MD) No.2195 of 2024 has been filed seeking to modify the order dated 11.12.2023 on the ground that the entire amount has now been settled.
5. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the first respondent submits that a referred charge sheet has been filed, as further action was 2/4
dropped, before the Judicial Magistrate No.2, Trichy West. A copy of the same is also placed before this Court.
6. In the light of this development, the final report in F.R.No.834 of 2018 has reached its logical conclusion with the referred charge sheet.
