Crl MP.No.3255 of 2023 in HCP SR.No.7844 of 2023 Crl MP.No.3255 of 2023 in HCP SR.No.7844 of 2023 M.SUNDAR, J., and M.NIRMAL KUMAR, J., (Order of the Court was made by M.SUNDAR,J.,) Captioned 'Criminal Miscellaneous Petition' [hereinafter 'Crl MP' for the sake of convenience and clarity] has been filed with a prayer to dispense with production of original of preventive detention order which has been challenged in the main 'Habeas Corpus Petition' [hereinafter 'HCP' for the sake of brevity].

2. Mr.A.John, learned counsel on record for petitioner adverting to paragraph No.12 of support affidavit submits that the original preventive detention order is not with the petitioner. Though this reason is not really adequate and more articulation is required, we make an exception for now [considering this a preventive detention case] and accede to the prayer. We make it clear that in the days to come, we may have to take a more serious view of such bare and bald averments eventhough the prayer is innocuous. Page Nos.1/2 https://www.mhc.tn.gov.in/judis
