JUDGMENT

The appellants/plaintiffs have filed the present second appeal against the Judgment and decree dated 18.12.2010 passed by the Learned I Additional Subordinate Judge, I Additional Sub Court, Erode in A.S.No.52 of 2009 confirming the Judgment and decree dated 27.02.2009 passed by the Learned District Munsifcum-Judicial Magistrate, District Munsif-cum-Judicial Magistrate Court, Kodumudi in O.S.No.94 of 2006.

2. Mr.K.R.Nishanth, learned representing counsel for the 1st to 3rd respondents, on record submits that the suit property has been handed over to the appellants/plaintiffs. The learned counsel for the appellants has also confirms the same.

3. Recording the submission made by the learned representing counsel for the 1st to 3rd respondents, this Second Appeal is Dismissed as Infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
