C.M.P.No.8523 of 2023 in C.M.A.SR.No.98400 of 2022 N.MALA,J, This Petition has been filed to condone the delay of 5 days in filing the above C.M.A.SR.No.98400 of 2022.

2.Mr.SP.Yuvaraj (Caveator), learned counsel appears for first respondent. 3.The learned counsel for the petitioner submits that second respondent remained ex-parte before the Tribunal and notice may be dispensed with and he has also made an endorsement to that effect. Hence notice to the second respondent is dispensed with.

4.I have gone through the affidavit filed in support of the petition and I am satisfied with the reasons stated therein, therefore, the delay of 5 days is condoned.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission. Registry is further directed to print the name of the respondent counsel at the time of admission.

Accordingly, this CMP is ordered.
