ORDER

Both side counsel present.

2. The learned counsel for the appellant would submit that due to change of officials and lack of communications, they are unable to file the second appeal in time.

3. The learned counsel for the respondent has raised objection stating that while there is a contempt petition against the respondents and the same is still pending before this Court, the appellants have filed the condonation petition in

filing the second appeal and thus raise objection in allowing the Civil Miscellaneous petition.

4. Having considered the facts and circumstances of the case and being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay of 778 in filing the second appeal is condoned on payment of costs of Rs.3000/- to the respondent's counsel.

5. The learned counsel for the appellant has paid Rs.3,000/- to the Counsel for the respondent before this Court today and the same is received by the respondent's counsel.

6. In view of the payment of the costs of Rs.3,000/- to the respondent's counsel, the Civil Miscellaneous Petition is ordered.

7. Post the matter on 27.02.2026.
